 Abstract 

The article is devoted to the issue of counterclaim application by the Respondent as one of the parties to the civil process. The article reveals the concept of a counterclaim, analyzes the definition of a claim given by various authors in their works. For a more detailed consideration of such a phenomenon as a counterclaim, the definition of the concept itself and the elements that characterize it is given. The peculiarity of a counterclaim is that it is presented only in the framework of the civil process, where the initial claim has already been accepted for trial. Based on the legal literature, the author of the article determines the relationship of the counterclaim with the original, which can be expressed, for example, in the offset of the main claim set out in the original claim, as well as the mutual exclusion of these two claims. In addition, the article shows the conditions for accepting a counterclaim by the court for its own production in accordance with the current legislation of the Russian Federation. In the end, the court, after considering the initial and counterclaims, makes a decision that contains a reasoned response to all the claims that are the subject of consideration.
